Terms of Service
Last updated October 19, 2026
These terms are an agreement between you and Datasense (“Datasense”, “we”, “us”) for using the website at usedatasense.com, the dashboard, the tracking script and SDK, the ingest and proxy endpoints, and the API (together, the “service”). By creating an account or using the service you agree to them. If you use Datasense for a company, you agree on its behalf and confirm you're allowed to.
1. The service
Datasense is a web analytics and error tracking tool, cookieless by default with an optional cookie script. You add our script to your websites, and we show you visitors, traffic sources, pages, goals, revenue, bot traffic and JavaScript errors in a dashboard, live and over time. You can serve the script from your own domain through a first-party proxy, and export your data.
2. Your account
- You must be at least 16 years old and give us a working email address.
- You sign in with a magic link or with Google. Keep access to that email or Google account secure; you're responsible for everything done through your account.
- Tell us right away at [email protected] if you think someone has accessed your account without permission.
- One person or organisation per account. Don't create accounts to get around plan limits or trials.
3. Plans, trials and billing
- Hobby is free, with the limits shown on the pricing page. Pro and Team are monthly subscriptions and start with a 14-day free trial (one trial per customer).
- Payments are handled by Dodo Payments, our merchant of record. It processes your card, issues invoices, and collects sales tax or VAT where it applies. Your purchase is also subject to Dodo Payments' terms. We never see or store your full card number.
- Subscriptions renew automatically each month at the then-current price until you cancel. If a renewal fails, we may limit paid features until it's paid.
- Prices are in US dollars and may change. We'll email you at least 30 days before a price change affects your subscription.
- You can cancel at any time; the plan stays active until the end of the paid period, then the account moves to Hobby. Refunds are covered by our Refund Policy: in short, payments for periods in which you used the service are not refunded.
4. Plan limits
Each plan includes a number of sites and a monthly pageview allowance, counted across all your sites per calendar month (UTC). If you reach the site limit, upgrade to add more. If you regularly go over your pageview allowance, we'll ask you to move to a plan that covers it; if you don't, we may limit access to the dashboard until you do. We never delete data because you went over a limit.
5. Acceptable use
You agree not to use Datasense to:
- track people on websites you don't own or aren't authorised to manage;
- send us special-category or sensitive data (health, biometrics, religion, government IDs, passwords, payment card numbers) or directly identifying data such as names and email addresses in page URLs, custom events, error messages or revenue events;
- track children's services in breach of laws that protect them;
- break the law, including privacy, consumer protection and anti-spam laws;
- send fake or automated traffic to inflate or disrupt reports, overload our endpoints, or use the proxy to relay traffic that isn't Datasense analytics;
- probe, scan or test our systems for vulnerabilities without our written permission, or bypass limits or security measures;
- copy, resell or white-label the service, or reverse engineer it except where the law allows.
We may suspend or close accounts that break these rules, with notice where reasonable.
6. Your data
- You own the analytics data collected from your sites (“customer data”). You give us permission to store and process it only to run, secure and improve the service for you, and to support you when you ask.
- For data about your visitors, you are the controller and we are your processor. Our Data Processing Agreement applies and forms part of these terms.
- You're responsible for having a lawful basis to measure your visitors and for telling them about it in your own privacy policy. The default script doesn't use cookies or persistent identifiers, which in many places means no consent banner is needed for it, but you are responsible for checking the rules that apply to you.
- If you switch a site to the cookie script, you are responsible for getting your visitors' consent wherever the law requires it, for example with a cookie banner, and for loading the script only after consent where that's required. Datasense doesn't provide consent banners and isn't responsible for how you collect consent.
- We don't sell customer data, use it for advertising, or combine it across customers.
- You can export your data at any time in CSV or JSON. You can ask us to delete a site or your account and its data at any time.
7. Our intellectual property
The service, its software, design and brand belong to Datasense. We give you a limited, non-exclusive, non-transferable right to use it under these terms while your account is active. If you send us feedback, we may use it without any obligation to you.
8. Availability and changes
We aim to keep Datasense running and your data safe, but the service is provided “as is” and “as available”, without a guaranteed uptime unless we've agreed one with you in writing. Ad blockers, network issues or bugs may mean some events aren't recorded. We may add, change or remove features; if we remove a major paid feature you rely on, we'll tell you in advance.
9. Termination
You can stop using Datasense and close your account at any time. We may suspend or end your access if you break these terms, fail to pay, or if we have to for legal reasons. When an account is closed we delete its data within 30 days, except what we must keep by law (such as billing records). Export anything you need first.
10. Disclaimers and liability
To the extent the law allows, we disclaim all warranties not stated in these terms, including fitness for a particular purpose and that analytics will be complete or exact. Datasense isn't liable for indirect or consequential losses, lost profits, revenue or data, and our total liability for any claim is limited to the amount you paid us in the 12 months before the claim. Nothing here limits liability that can't be limited by law.
You agree to cover our reasonable costs from claims by third parties arising from your sites, your data or your breach of these terms.
11. Changes to these terms
We may update these terms. We'll email you about material changes at least 14 days before they take effect. If you keep using Datasense after that, the new terms apply; if you don't agree, cancel before they take effect.
12. Governing law
These terms are governed by the laws of India, and its courts have exclusive jurisdiction over disputes, except where consumer law gives you the right to bring a claim where you live.
